Abstract:

The involuntary hospitalization of a patient with psychic disorders is made according to Law no. 487/2002 republished. As such, the most frequent involuntary hospitalized patients in the psychiatric wards are those who suffer from paranoid schizophrenia and ma-niacal episodes. In DSM II (published for the first time in 1968), the schizoaffective disorder was considered a subtype of schizophrenia and it referred to the group of patients with psychic disorders who met the schizophrenia criteria, while presenting, at the same time, changes in their disposition, regardless of their type. The majority of female patients with psychic disorders have children, but their pregnancy represents a great risk for the foetus and can provoke relapses. The aim of this paper is to highlight the ethical and legal issues connected to a case hospitalized in an involuntary manner with the diagnosis of schizoaffective disorder, maniacal episode. The 31 year old female patient was diagnosed with schizoaffective disorder four years earlier; she had had psychic symptoms and had been hospitalized many times in the “Socola” Psychiatric Institute since she was 20. During her last hospitalization, the patient with schizoaffective disorder was pregnant in weeks 16 ? 17. According to the Law for the patient’s rights no. 46/2003, art. 17, an arbitration panel is assembled. The members of the arbitration panel decide for the patient without autonomy. Conclusion: Should we respect the autonomy vs the benefit of the patient with schizoaffective disorder, maniacal episode and first trimester pregnancy? This case arouses multiple ethical discussions when the patient and her family disagree with the therapeutic abortion for the patient’s benefit.
